Welcome to Care4Kid.com, a premier parental monitoring and child safety platform ("Care4Kid," "we," "us," or "our"). These Terms of Service ("Terms," "Terms of Service," "Terms and Conditions," or "Agreement") constitute a legally binding agreement between you ("User," "Subscriber," "Parent," or "Legal Guardian") and Care4Kid regarding your access to and use of our family safety platform, website, applications, software, and associated digital parenting tools (collectively, the "Services" or "Software").

Care4Kid provides state-of-the-art parental control software, device monitoring services, screen time management, location tracking services, and online child safety tools designed exclusively to help parents and legal guardians protect their children in the digital landscape. By providing actionable insights into your child's online and offline device activities, our platform empowers you to establish safe digital boundaries.

These Terms govern your use of the Care4Kid website located at https://care4kid.com (the "Site") and all related subdomains, mobile applications, downloadable software, and any digital content offered. Please read these Terms of Service thoroughly before creating an account, downloading our application, or subscribing to our services. Your continued use of the Care4Kid platform signifies your understanding and unconditional acceptance of this Agreement.

By accessing the Care4Kid website, downloading the Care4Kid parental control application, registering for an account, purchasing a subscription, or otherwise utilizing any of our child device monitoring features, you expressly represent, warrant, and agree that you have read, understood, and accept all the terms and conditions contained in this document.

If you do not agree with any part of these Terms, you must immediately cease all use of our Services, delete any installed Care4Kid software from your devices, and refrain from accessing the Care4Kid platform. We reserve the right, at our sole discretion, to deny access to our Services to anyone who violates these Terms or whose conduct we deem unlawful or inappropriate.

This Agreement applies to all visitors, users, and others who access the Service. By checking the "I Agree" box during registration or by continuing to use the software, you enter into a legally binding contract with Care4Kid.

The installation of the Care4Kid monitoring application requires physical access or authorized administrative access to the target device. You, the user, agree that you are installing the software solely on devices that you legally own, or for which you have explicit, documented consent from the device owner and the user of the device to install our family security software.

You acknowledge that Care4Kid provides comprehensive installation guides, but the successful installation and configuration of the software are entirely your responsibility. Depending on the operating system of the target device, certain features may require additional permissions, such as rooting (for Android devices) or jailbreaking (for iOS devices), to function correctly. Care4Kid provides no warranties or guarantees regarding the success of such modifications, and you assume all risks associated with altering your device's firmware or operating system. You are fully responsible for complying with the warranty terms provided by your device manufacturer.

Care4Kid offers a robust suite of child monitoring app features designed to facilitate online child safety. Our monitoring application provides various functionalities, including but not limited to: * Location Tracking Services: Real-time GPS location tracking and geofencing alerts. * Screen Time Monitoring: Tracking overall device usage and setting daily limits. * App Usage Analytics: Identifying the applications installed and used by the child. * Communication Oversight: Monitoring text messages, call logs, and instant messaging application activity where technically feasible and legally permissible. * Web Filtering and Browsing History: Tracking visited websites and blocking inappropriate content.

You understand and agree that the availability of specific monitoring features may vary depending on the target device's operating system, version, network connectivity, and other technical limitations. Care4Kid reserves the right to modify, add, or remove features within the parental monitoring software at any time without prior notice to adapt to evolving technical ecosystems and legal landscapes.

The term "Software Application" refers to all proprietary code, applications, interfaces, and algorithms developed by Care4Kid to deliver our services. The Software Application operates silently in the background (where supported by the OS) or as a visible application on the target device to collect data and transmit it securely to your user dashboard.

Care4Kid is not a utility for tracking unconsenting adults. Our Software Application is engineered explicitly as a family protection platform for parents and legal guardians. The use of our technology for unauthorized surveillance, corporate espionage, or stalking is strictly prohibited and constitutes a material breach of these Terms of Service.

To become a lawful user of the Care4Kid digital parenting tools, you must satisfy the following mandatory requirements: 1. Legal Authority: You must be the parent or legal guardian of the child you intend to monitor, or you must be the legal owner of the device on which the software is installed and have the explicit, documented consent of any adults using the device. 2. Lawful Intent: You must use the Care4Kid platform strictly for legal purposes, specifically for child safety, parental monitoring, and family protection. 3. Compliance with Local Laws: You are solely responsible for determining the legality of using monitoring software in your specific jurisdiction. Laws regarding privacy, consent, and digital monitoring vary significantly by country, state, and region. 4. Accurate Information: You must provide accurate, current, and complete information during the account registration process.

Failure to meet any of these mandatory requirements immediately nullifies your license to use the Care4Kid platform and may subject you to account termination and legal liability.

By using the Care4Kid website and purchasing our services, you represent and warrant that you are at least 18 years of age, or the age of majority in your jurisdiction, and possess the legal capacity to enter into binding contracts. The Care4Kid platform is designed for adults to monitor their minor children. Minors are strictly prohibited from creating accounts or purchasing subscriptions.

While the Care4Kid application is installed on devices used by minors, the contractual relationship and the account ownership reside entirely with the adult subscriber. We do not knowingly collect personal or payment information directly from children under the age of 13 without verifiable parental consent.

Care4Kid strictly prohibits the use of its parental control software for any malicious, illegal, or unauthorized purposes. You explicitly agree NOT to: * Install the monitoring application on a device you do not own or lack the legal right to monitor. * Monitor individuals (including spouses, employees, or partners) without their explicit, legally valid consent. * Use the service for stalking, harassment, intimidation, extortion, or any form of domestic abuse. * Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Care4Kid software. * Modify, adapt, translate, or create derivative works based on our technology. * Bypass, disable, or interfere with any security features or licensing mechanisms of the platform. * Resell, sublicense, distribute, or commercially exploit the Software Application without explicit written authorization from Care4Kid.

We reserve the right to immediately terminate your account without a refund and cooperate with law enforcement authorities if we suspect that you are using our services in violation of these usage restrictions or any applicable laws.

To utilize the Care4Kid platform, you must register for a user account. You are solely responsible for maintaining the strict confidentiality of your account credentials, including your email address, username, and password.

You agree to accept responsibility for all activities, data access, and device modifications that occur under your account. If you suspect or become aware of any unauthorized access to your account or any other breach of security, you must notify Care4Kid immediately at support@care4kid.com.

Care4Kid employs robust encryption and security protocols to protect your dashboard; however, the security of the data also relies on your adherence to strong password practices and the physical security of the device you use to access the dashboard. Care4Kid shall not be liable for any loss or damage arising from your failure to safeguard your account credentials.

The use of Care4Kid's advanced family security software requires the payment of subscription fees. By selecting a subscription plan and providing payment information, you authorize Care4Kid (and our designated third-party payment processors) to charge the applicable fees to your selected payment method.

All fees are stated in US Dollars (USD) unless otherwise specified, and are exclusive of applicable taxes, levies, or duties imposed by taxing authorities. You are responsible for the payment of all such taxes.

If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms or suspend/terminate your access to the Services until payment is successfully processed.

Care4Kid offers various subscription tiers (e.g., monthly, quarterly, annual). * Auto-Renewal: To ensure uninterrupted monitoring and child safety, all Care4Kid subscriptions are set to automatically renew at the end of the current billing cycle. * Cancellation: You may cancel your subscription auto-renewal at any time through your Care4Kid user dashboard. Cancellation of auto-renewal must be completed at least 24 hours before the end of the current billing period to avoid being charged for the subsequent cycle. * Continued Access: Upon cancellation, you will retain access to the Care4Kid services until the end of your currently paid billing period. We do not provide prorated refunds for mid-cycle cancellations.

Care4Kid stands by the quality of our parental control application. However, due to the digital nature of our services and the immediate availability of the technology upon purchase, our refund policy is strict and specific.

Refunds may only be granted if you encounter insurmountable technical issues that prevent the software from functioning as advertised, provided that: 1. You have fully complied with all installation and compatibility requirements. 2. You have contacted our Customer Support team and allowed them a reasonable opportunity (at least 72 hours) to resolve the issue. 3. The issue is proven to be a flaw in the Care4Kid software, not a limitation of the target device, carrier, or user error.

Refund requests must be submitted within 14 days of the original purchase date. Refunds are not granted for changes of mind, failure to understand the technical requirements, or if the target device user uninstalls the application. Renewal payments are non-refundable.

Care4Kid is designed to operate on specific operating systems and device versions (primarily Android and iOS). It is your sole responsibility to check the compatibility of your target device with our Software Application prior to purchasing a subscription.

The compatibility list is available on our website and is updated periodically. We do not guarantee that our software will be compatible with beta versions of operating systems, highly customized ROMs, or extremely outdated devices. Failure to verify compatibility before purchase does not constitute grounds for a refund.

For the Care4Kid platform to function effectively and transmit monitoring data to your dashboard, the target device must meet certain continuous technical preconditions: * Active Internet Connection: The device must have continuous or frequent access to an active cellular data network or Wi-Fi. Data cannot be synced to your dashboard if the device is offline. * Sufficient Battery Life: The device must be powered on. * Proper Configuration: The device settings (e.g., battery optimization, background data restrictions) must be configured correctly according to our installation guides to prevent the operating system from terminating the Care4Kid background process.

Care4Kid is not responsible for data delays, loss of tracking, or service interruptions caused by a lack of internet connectivity, dead batteries, or interference from third-party security apps on the target device.

To maintain security, compatibility, and the highest standards of child safety technology, Care4Kid may periodically release software updates, patches, or upgrades.

Some updates may require physical access to the target device for manual installation. You agree to promptly install all updates provided by Care4Kid. We reserve the right to modify, suspend, or discontinue any specific feature or component of the Service at any time, with or without notice, to enhance the platform's overall stability and performance.

The Care4Kid platform, including but not limited to the website, Software Application, source code, algorithms, databases, design, UI/UX, graphics, text, and overall "look and feel," are the exclusive property of Care4Kid and its licensors. These assets are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You acknowledge that you acquire no ownership rights or title to the software or the platform by using our services. Your rights are strictly limited to the license granted in Section 18 of these Terms.

"Care4Kid," the Care4Kid logo, and all other related product and service names, design marks, and slogans are the trademarks or registered trademarks of Care4Kid. You may not use these trademarks in connection with any product or service that is not affiliated with Care4Kid, in any manner that is likely to cause confusion among consumers, or in any manner that disparages or discredits Care4Kid.

Subject to your continuous compliance with these Terms and payment of applicable fees, Care4Kid grants you a limited, non-exclusive, non-transferable, revocable, and strictly personal license to: 1. Download and install the Care4Kid application on a specified number of devices corresponding to your purchased subscription plan. 2. Access and use the Care4Kid dashboard and monitoring features solely for personal, non-commercial, family safety purposes.

This license does not allow you to distribute, sell, lease, rent, or sublicense the Software. Care4Kid reserves all rights not expressly granted to you in these Terms. This license automatically terminates if you violate any provision of these Terms.

"User Content" refers to the data, logs, locations, messages, and media collected by the Care4Kid application from the target device and transmitted to your dashboard.

You retain all rights and ownership of your User Content. Care4Kid claims no ownership over the data you monitor. By using the service, you grant Care4Kid a strictly limited, encrypted, and automated license to host, store, and process this data exclusively for the purpose of displaying it to you in your dashboard and providing the Services.

Your privacy and the privacy of your data are paramount. Our data collection, storage, and processing practices are detailed comprehensively in our Privacy Policy, which is incorporated by reference into these Terms. By using Care4Kid, you consent to the data practices outlined in our Privacy Policy. We strongly encourage you to review it carefully.

Care4Kid is designed for real-time and recent historical monitoring, not as a permanent cloud storage solution. You understand and agree that Care4Kid will only retain your User Content (such as call logs, texts, and location history) for a limited period, typically corresponding to the active status of your subscription or a rolling chronological window (e.g., 30, 60, or 90 days), as determined by your specific plan.

Upon account expiration, termination, or user deletion, Care4Kid reserves the right to permanently and irretrievably delete all historical data associated with your account in compliance with our data minimization and privacy policies.

We implement industry-standard administrative, technical, and physical safeguards designed to protect your information and User Content from unauthorized access, loss, misuse, or alteration. Data transmitted between the target device and our servers is encrypted using modern cryptographic protocols (e.g., TLS/SSL).

Despite our best efforts, no system can be guaranteed 100% secure. You acknowledge that you provide your data at your own risk. Care4Kid shall not be held liable for security breaches resulting from zero-day exploits, sophisticated cyber-attacks, or compromised user credentials.

If you decide to terminate your use of Care4Kid, it is your responsibility to manually uninstall the software application from the target device(s). Deleting your Care4Kid account or canceling your subscription does not automatically remove the software from the device. Comprehensive uninstall instructions are provided in our documentation and support center.

Our website or dashboard may contain links to third-party websites, resources, or services that are not owned or controlled by Care4Kid. These links are provided for your convenience only. Care4Kid has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Your use of such third-party sites is entirely at your own risk.

Care4Kid reserves the right to modify, pause, or discontinue the Services, temporarily or permanently, with or without notice to you. You agree that Care4Kid shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

We do not guarantee that the Services will be available continuously without interruption. Planned maintenance, emergency repairs, or unforeseen server/network failures may cause temporary service outages.

YOUR USE OF THE CARE4KID PLATFORM, SOFTWARE, AND SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARE4KID EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

CARE4KID DOES NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE USE OF THE SERVICES WILL BE RELIABLE; OR (D) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

If you are dissatisfied with any portion of the Care4Kid Services, or with any of these Terms of Service, your sole and exclusive remedy is to discontinue using the Services, cancel your subscription, and uninstall the Software from all devices.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CARE4KID, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF CARE4KID HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: 1. THE USE OR THE INABILITY TO USE THE SERVICES; 2. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; 3. CONDUCT OF ANY THIRD PARTY ON THE SERVICE; 4. ANY LEGAL ACTION TAKEN AGAINST YOU DUE TO YOUR UNLAWFUL USE OF THE SOFTWARE; 5. ANY OTHER MATTER RELATING TO THE SERVICES.

IN NO EVENT SHALL CARE4KID'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO CARE4KID FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Care4Kid, its parent companies, affiliates, officers, directors, employees, consultants, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise directly or indirectly from: 1. Your violation or breach of these Terms of Service; 2. Your unlawful, unauthorized, or improper use of the Care4Kid platform or software; 3. Your violation of any applicable laws, regulations, or third-party rights, including privacy rights; 4. Any claim that your use of the service caused damage to a third party.

Care4Kid reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate fully with our defense of such claim.

You may not assign, transfer, or delegate any of your rights or obligations under these Terms of Service without the prior written consent of Care4Kid. Care4Kid may freely assign or transfer its rights and obligations under these Terms, in whole or in part, without restriction and without notice to you.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Delhi, India, without regard to its conflict of law principles.

You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within New Delhi, India to resolve any dispute or claim arising from these Terms.

Care4Kid shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms will remain in full force and effect. The invalidity of a specific provision shall not affect the validity of the entire Agreement.
